Il saggio focalizza anzitutto il contesto politico-culturale e la dottrina giuspubblicistica degli anni ’30 del Novecento, per poi soffermarsi sui principali contributi scientifici di Costantino Mortati di quel periodo, L’ordinamento del governo nel nuovo diritto pubblico italiano (1931) e La Costituzione in senso materiale (1940), con particolare riferimento al concetto di Stato e di Stato moderno in Mortati, alla critica dello Stato liberale, all’alterazione dell’ordinamento costituzionale dello Statuto albertino ed alla teoria della costituzione in senso materiale.

The essay focuses first of all on the political-cultural context and the public law doctrine of the 1930s, and then focuses on the main scientific contributions of Costantino Mortati of that period, The order of government in the new Italian public law (1931) and The Constitution in the material sense (1940), with particular reference to the concept of the State and the modern State in Mortati, to the criticism of the liberal State, to the alteration of the constitutional order of the Albertine Statute and to the theory of the constitution in the material sense material.
