The paper analyses Rosario Livatino’s legal thinking and shows how relevant it is for our times, especially with regard to three aspects. The first concerns the relationship between positive law and natural law, which constitutes a point of convergence between believers and non-believers. The second aspect deals with the role of Catholic jurists in the world and with the support Livatino got from his faith in order to carry out his work as a judge. The third profile is about the relationship between law and judge as well as the risks of judicial activism.

Lo scritto analizza il pensiero di Rosario Livatino, evidenziandone la profonda attualità, in particolare sotto tre profili. Il primo di essi è legato al rapporto tra diritto positivo e diritto naturale, che costituisce un punto di convergenza tra credenti e non credenti. Il secondo aspetto trattato è relativo al ruolo dei giuristi cattolici nel mondo e all’ausilio che veniva a Livatino dalla fede per lo svolgimento del suo lavoro di magistrato. Il terzo profilo analizzato è quello del rapporto tra legge e giudice, in una prospettiva critica di ciò che gli americani chiamano judicial activism.
