Il volume affronta il tema della sinodalità dal punto di vista della scienza canonistica e in una prospettiva concreta, per valorizzare la permanente capacità dei giurisperiti di collaborare al perfezionamento del sistema normativo della Chiesa, nel dialogo tra di loro e con l’autorità di governo ecclesiale. I contributi raccolti hanno trovato approfondimento in due laboratori di ricerca che si sono efficacemente intrecciati tra di loro: il Convegno “La sinodalità nell’attività normativa della Chiesa. Il contributo della scienza canonistica alla formazione di proposte di legge”, che si è svolto presso l’Università degli Studi di Torino dal 3 al 4 ottobre 2022 ed è stato organizzato insieme all’Associazione dei docenti universitari della disciplina giuridica del fenomeno religioso (Adec), e il progetto di ricerca sviluppato da un gruppo di canonisti e diretto a elaborare due proposte di legge su aspetti essenziali dell’esercizio del munus petrinum che non trovano una regolamentazione adeguata nella normativa vigente, l’una sulla sede romana impedita e l’altro sulla rinuncia del Romano Pontefice.
Nella prima parte del volume sono comprese le riflessioni dedicate ad approfondire l’indole sinodale della Chiesa e le implicazioni di questa dimensione costitutiva in ordine al modo di esercitare la funzione legislativa e alle responsabilità della dottrina canonistica di contribuire con la propria competenza alla formazione di norme giuste. Il discernimento dei canonisti viene messo poi alla prova nella seconda parte del volume, che contiene le presentazioni delle due proposte di legge e i molteplici commenti e suggerimenti per migliorarne la formulazione. I risultati dello sforzo sinodale sono infine affidati alla terza parte del volume, ove viene riportata una relazione conclusiva su tutto il lavoro di stesura delle proposte di legge e sono pubblicati i testi delle norme risistemati a seguito della discussione comune.

 

The volume faces the theme of sinodality by the point of view of the canonical legal science and in a concrete perspective, in order to highlight the jurists’ permanent ability to cooperate for the improvement of the legal system of the Church, in a dialogue among them and with the ecclesial government authority. The essays gathered here found an opportunity of further study in two research laboratories which efficiently intertwined: the Congress “Sinodality in the law-making activity of the Church. The contribution of the canonical legal science to the formation of law proposals”, which was organized together with the Association of University Professors of the juridical condition of the religious phenomenon (Associazione dei docenti universitari della disciplina giuridica del fenomeno religioso – Adec) and was held at the University of Turin on October 3-4, 2022, and the research project that was developed by a group of canonists in order to draft two law proposals on aspects that, although essential for the exercise of the munus petrinum, are not regulated adequately in the current legislation: the one, regarding the impeded Roman See; the other, concerning the Roman Pontiff’s resignation.
In the first part, the volume includes the reflections that were meant to investigate the synodal disposition of the Church and the implications of this constitutive dimension on the exercise of the legislative activity and on the responsibility of the canonical legal science of giving its contribution – thanks to its expertise – to the development of just laws. The canonists’ discernment is then put to test in the second part of the volume, which includes the presentation of the two law proposals and the many comments and suggestions that were intended to improve their formulation. In the end, the results of the synodal effort are entrusted to the third part of the volume, in which a final report of the whole work about the drafting of the law proposals is presented and the texts of the laws themselves, as updated after the collective debate, are published.
